This site is primarily an advertising facility for work-seekers and potential employers and is owned and operated by JobsbyMe.

Users of this site and the services available are deemed to accept these terms and conditions and any additional terms and conditions which expressly apply to services and information provided by third parties.

Users are defined as individuals looking for employment opportunities (work-seekers), potential employers (clients) including both employment agencies and employment businesses (as defined by the Employment Agencies Act 1973).

All copyright, database rights and other intellectual property rights in the site and the material available on the site belong to JobsbyMe and / or its suppliers. These remain the property of JobsbyMe and users have no claim to the rights of any such materials.

Information provided through this site is intended for use by work-seekers and clients who may use, print and download information from the site for these purposes only. Users may not otherwise reproduce. copy, display, transmit or distribute any material from the site for personal or other commercial purposes.
Users of this website are subject to the following terms and conditions, which you are deemed to accept each time you se the website.

Data Protection
The use of CVs and other personal information on the JobsbyMe site is governed by our privacy policy

CVs and Job Advertisements
CVs and job advertisements are provided by work-seekers and by clients or their agents and are not reviewed by us. JobsbyMe accept no responsibility or liability for the contents of CVs, advertisements or any other information provided by work-seekers or clients.
Work-seekers are expected to provide true and accurate information.

Suitability and references
Clients are responsible for ensuring work-seekers satisfy any qualifications, permissions required by law, medical and other requirements as required and for obtaining verification of any qualification or permissions. JobsbyMe accepts no liability for any loss or damage arising from potential employers' failure to obtain independent verification, instead relying solely on information provided on the site.
JobsbyMe accepts no liability for any loss or damage incurred by work-seekers arising from any false or inaccurate claims made by clients

Service availability
JobsbyMe endeavours to maintain continuous, uninterrupted availability of the site and all the services available on it but accepts no responsibility for the consequences of interruptions or delays, however caused. Jobsbyme may enhance the functionality, design and specification of the site at any time but endeavour to keep disruptions to a minimum.

Limitation of liability
Our liability and the liability of our third party suppliers for any loss or damage suffered as the result of direct use of this site is limited to direct damages only and excludes any loss of future earnings, profit or any consequential or speculative loss.

Payments
JobsbyMe job seeking services are free to use. There is no need for work-seekers to provide bank details when applying for jobs. If work-seekers receive such a request they should contact JobsbyMe immediately.

Governing law
These terms and conditions shall be interpreted in accordance with English law and all disputes shall be decided by the English courts.

Browser and operating system policy
JobsbyMe endeavours to support as many users as possible, but it has become necessary to cease supporting some browser versions. If your browser is not supported, you may still be able to access our site, but you may encounter some display problems?
JobsbyMe also requires work-seekers to enable session cookies (enabling permanent cookies is recommended)

In these terms and conditions:

'Client' means any person, company, organisation or firm which purchases services from us;
a. 'Advertising Agreement' means an order for Services on a form provided by us (in any format) and signed by a Customer;
b. 'Services' means all recruitment products and services made available by us from time to time;
c. 'Contract Month' means, in respect of any Advertising Agreement relating to the provision of Services for a specified period of months, the calendar month commencing on the start date specified in the Order Form and ending on the day before the same date in the next calendar month. For example, the calendar month commencing on 8th November and ending 7th December.
d. 'Contract Term' relates to the duration and means the full term specified in the Advertising Agreement.
Commencement of Services
The provision of services will commence only when a signed Advertising Agreement has been returned to us and has been approved by us.

Charges
Charges are guaranteed for the period of time stated on the Advertising Agreement. Charges are strictly confidential and may not be disclosed by the Client to other customers or any third party.

Unlimited posting: All jobs posted on JobsbyMe will remain live for a maximum of one calendar month provided the account remains live and paid to terms.

Single advertisements. A single advertisement fee agreed in advance will be charged for each job. A single job is identified by its unique number and is valid for one month. If a customer deletes a job and then either reposts it or posts another, this will be classed as two separate jobs.

Additional advertising
Clients may also purchase additional advertising on JobsbyMe subject to availability.
If a customer has paid for services to be used within any time period specified on the Advertising Agreement which are subsequently not used within that period of time they may not be carried over into any subsequent period without our prior written consent. The Client remains liable for payment for any unused services.

Commencement of Services
JobsbyMe will not commence the provision of Services pursuant to any Advertising Agreement until the Advertising Agreement has been returned to us, in a form approved by us and signed by the Customer.

A job posted on Jobsbyme will remain live for 28 days or such shorter time as we agree with the Customer. Any extension of this time will be charged to the Customer as a new posting. A single job is identified by its unique ID number. If a customer deletes a job and then either reposts it or posts another, this will be classed as two jobs.
If a customer has paid for services to be used within any time period specified on the Advertising Agreement which are subsequently not used within that period of time they may not be carried over into any subsequent period without our prior written consent. The Client remains liable for payment for any unused services.

Payments
All prices exclude VAT. Payment can be made by credit card.
Subject to approval credit accounts can be set up, invoiced on 30 day terms.
Late payment will entitle us to suspend provision of services immediately. Interest will be payable on late payments at the rate of 3% above base rate.

Termination
The Client may terminate the provision of Services under any Advertising Agreement by no less than 30 days notice to expire at the end of a Contract Month but there will be no entitlement to refund for any unused credits.
JobsbyMe may terminate the provision of services if:
i. the Customer is in breach of these terms and conditions
ii. the Customer becomes insolvent, ceases to trade or goes into liquidation.

Limitation of liability
Our total liability to Clients in respect of any Services, except for death or personal injury caused by our negligence, is limited to the total amount paid to us during the Contract Term for such Services.
Job advertising

Job adverts go live within 24 hours after payment confirmation based on a working week from Monday to Friday, 9.00am to 5.00pm

Employment Agencies and Employment Business Regulations 2003
Work-seekers and recruiters need to be aware that this job board operates as a venue only and does not introduce or supply work-seekers to recruiters (or vice versa) under the terms of the Conduct of Employment Agencies and Employment Business Regulations 2003

For the avoidance of doubt we do not propose or introduce work-seekers under the terms of the Conduct of Employment Agencies and Employment Business Regulations 2003. This means we do not:
• confirm the identity of a work-seeker or that they have the experience, training, qualifications or authorisation to work in the position to be filled or that they wish to undertake the role to be filled;
• ensure the work-seeker and recruiter are each aware of any requirement imposed by law or otherwise which must be satisfied by either of them to permit the work-seeker to fulfil the position to be filled;
• provide any recommendation about whether work-seekers are suitable for any position advertised
• take up any references in relation to a work-seeker; or make any arrangements for accommodation of work-seekers.

The Rules are:

1. No duplicating of jobs at the expense of other clients' jobs.
2. No excessive and or inappropriate use of keywords in job advertisements which, in the opinion of JobsbyMe, is intended to influence position in the results listing, or increasing the number of page views and may detract form the overall presentation of information on the site.
3. All advertisements must be for genuine vacancies only. Any other products or services, even if related to recruitment must not be advertised.

Illegal Advertisements
Advertisements which appear to discriminate on any grounds covered by English law may result in legal action being taken against both the advertiser and the publisher.

If we believe that an advertisement may be discriminatory or contain inappropriate wording in any way we may, at our discretion, either amend the advertisement or remove it immediately without liability to you to make any refund of amounts paid or due. In these unlikely circumstances we will inform you accordingly.

Responses to advertisements
Clients agree to deal fairly and professionally with individuals who may respond to an advertisement. Clients undertake not to do anything which may bring JobsbyMe into disrepute.

JobsbyMe offers no guarantees with regard to numbers and suitability of applicants for job advertisements
Clients agree to indemnify JobsbyMe from any claim brought by any individual arising from any breach of these terms and conditions.

Equipment
JobsbyMe is an internet based job site available through the world wide web. Clients should ensure that they have the appropriate equipment and services to enable them to use JobsbyMe.

Content and links
Clients are responsible for any profile content and for maintaining the links to any linked sites.
If we believe any advertisement or link contains defamatory, illegal or offensive content and may bring JobsbyMe we reserve the right to remove it without liability to you to make any refund of amounts paid or due.

Third party sites
Vacancies posted on JobsbyMe may also appear on third party recruitment web sites pursuant to agreements from time to time between JobsbyMe and other websites. This is done with the sole intention of attracting a wider audience.

The site will work across all main browsers, Firefox 2.X and IE 5.X, 6.X, 7.X utilizing HTML 4.01 Transitional and XHTML 1.0 Strict.

JobsbyMe also requires users of recruiter services to enable session cookies (enabling permanent cookies is recommended), and JavaScript, in their browser.

Use of candidate database
Any searching, screening or filtering tools are designed to help clients assessment the suitability or otherwise of candidates or vacancies. They are to assist users in taking these steps, but are not intended as a substitute.

Database rights
Database rights and all other applicable copyright and intellectual property rights in the candidate database belong to JobsbyMe. You acknowledge that you do not acquire any rights in the database or its content and that your retention and use of the database and its content is governed by these terms and conditions.
Use of the database

The material you are entitled to receive from the candidate database is determined by the product you have purchased and detailed in the Advertising Agreement. Users may:

i. Access, search or download details using the Candidate Search facility and its associated functions for the purpose of finding suitable candidates for specific job vacancies.

ii. Use the information about the work-seekers in the database to contacting them (either directly or through JobsbyMe) in relation to specific job vacancies.

iii. Use the information is restricted solely to recruitment-related activities.
Users may NOT:

i. Supply, sell or license material from the candidate database, or a copy of it, to any other person, associated company or third party

ii. Download the database through any automated process.

iii. Contact the individuals on the database or make or allow any use of the information about those individuals, other than for the purpose of finding suitable candidates for specific job vacancies.

iv. Act in any way that contravenes the Data Protection Act 1998 and all subsequent legislation and regulations.
Dealings with work-seekers

Users agree to deal fairly and professionally with individuals you may contact using information from the database and not do anything which may bring JobsbyMe into disrepute. Users will indemnify JobsbyMe against any claim brought by an individual arising from your breach of this obligation or any other of these terms and conditions.

Passwords are for the sole use of the person to whom they are issued. If we reasonably believe that a password is being used by an unauthorised person (in breach of our terms) we may deny access.

Online advertising

1. These terms and conditions apply to all advertising accepted by JobsbyMe for display on the web site jobsbyme.co.uk. Users accept these terms and conditions. For the avoidance of doubt, these terms also apply to users acting as an agent or buyer for the actual advertiser.

2. To cancel or alter any order users must inform us, by fax or email at the number or address on provided.

3. Users are responsible for the content of the advertisements and for ensuring compliance with all relevant legislation and codes of practice.

4. In the event of a complaint about content we may, at our discretion, remove the advertisement from display without reference or liability. Users will indemnify us against any claim that the advertisement or its content infringes the intellectual property rights or other rights of others or is defamatory or otherwise offensive.

5. Employment agencies and/or employment businesses (as defined by the Employment Agencies Act 1973) must ensure advertisements comply with the Conduct of Employment Agencies and Employment Businesses Regulations 2003.

6. Users sole remedy if we, or our third party subcontractors who may host and serve advertising from time to time, make an error in displaying any advertisements shall be liable in any circumstances for any loss of profit or business. We shall, additionally, have no liability for failure to display the advertisements if caused by circumstances beyond our control.

Employment agencies and employment businesses
Employment agencies and employment business (as defined by the Employment Agencies Act 1973 ('the Act') are responsible for ensuring that the use of information complies with their obligations under the Act and the various regulations made under it, together with any applicable guidelines.

Rights in the database
JobsbyMe holds the rights to the Database and all other applicable copyright and intellectual property rights. Clients acknowledge that they do not acquire any rights in the JobsbyMe database or its content and use of the information contained within the database is governed by these terms and conditions.

Use of the database
Payment of agreed charges entitles:

i. Access to JobsbyMe database to search, save searches and/or download work-seekers for the purpose of finding suitable candidates for specific job vacancies that you wish to fill.

ii. Contact work-seekers either directly or through JobsbyMe subject to the provision of appropriate contact details by the work-seekers in relation to specific vacancies.

iii. Use the information only in connection with recruitment-related activities.

Users must, at all times, comply with the Data Protection Act 1998 and all other legislation and regulations.
You may NOT:

i. Supply, sell or license material from the candidate database, or a copy of it, to any other person, third part or company including another member of your group of companies.

ii. Download the database through any automated process.

iii. Contact the individuals on the database or make or allow any use of the information about those individuals, other than for the purpose of recruitment.
